Bethany Beach market overview

Bethany Beach is the quiet resort on Delaware's southern shore: a small, family-oriented town with a boardwalk and a guarded ocean beach, set between Delaware Seashore State Park to the north and South Bethany and Fenwick Island to the south. It sits within a few hours' drive of Washington, Baltimore and Philadelphia, and most guests arrive by car for a week or a long weekend.

Demand follows the school calendar closely. Top homes are booked about two nights in three in June, close to nine in ten in July and nearly eight in ten in August, at the year's highest nightly rates. September keeps a useful shoulder, at about four nights in ten, as families give way to couples and weekend visitors. From November through March the market is close to empty, which makes winter the time for repairs, upgrades and owner stays.

The Town of Bethany Beach publishes its beach, parking and event information for visitors.

Vacation Rental Taxes and Regulations in Bethany Beach, DE

Short-term rentals are allowed in and around Bethany Beach

You can rent a Bethany Beach home by the night, week or season. What it owes depends on whether it sits inside the Town of Bethany Beach. The town itself is small, and many homes with a Bethany Beach address, including the communities along and west of Route 1 toward South Bethany, are outside its limits in unincorporated Sussex County. There, Delaware's lodging tax is the only lodging tax and no town rental licence applies. Inside town limits, rentals of any length are permitted with a town rental licence and the town's rental tax.

Lodging taxes

Delaware levies a 4.5% short-term rental lodging tax on every stay of 31 consecutive nights or fewer, administered by the Delaware Division of Revenue. It is charged on the rent alone; cleaning fees, linen fees and security deposits are excluded. The tax is filed monthly, by the 15th of the following month. Sussex County's own lodging tax applies to hotels, motels and tourist homes, not to rental homes.

Inside town limits, the Town of Bethany Beach adds a 7% rental tax on gross rental receipts, paid to the town rather than the state. It is due twice a year, on June 1 and November 1.

Registering your rental

The town requires a rental licence for any property rented at any time during the year, with a separate licence for each rental unit. Licences run from June 1 to May 31, and applications and renewals are due by June 1. No residential licence is issued without a signed safety certification confirming that the home has:

  • a smoke detector on every level and in every bedroom, with fresh batteries fitted at each application or renewal;
  • exterior deadbolts that open from the inside without a key;
  • GFCI protection on outdoor, bathroom, kitchen, garage and crawl-space outlets;
  • address numbers at least four inches high, visible from the street;
  • secure locks on windows within twelve feet of the ground.

A home found out of compliance after the licence is issued can lose it.

How Fairly handles it

Fairly collects and remits Delaware's short-term rental lodging tax on every booking and, for homes inside town limits, the Town of Bethany Beach rental tax, and registers your home for both. We assist with the town licence application, its annual renewal and the safety items it certifies. Neighbouring South Bethany, Ocean View and Millville each license rentals and levy their own rental tax; our Sussex County page compares the beach towns.

Operating a vacation rental in Bethany Beach, DE

Operating a Bethany Beach rental means running a full year's business inside about fourteen weeks. From mid-June to late August stays run back to back, so cleaning, linen, beach gear and restocking have to be finished between one checkout and the next check-in. Salt air and sand are hard on decks, outdoor showers, HVAC units and door hardware, and small problems are best caught during the season rather than after it.

The off-season is quiet but not idle. Homes sit empty for weeks at a time through winter coastal storms, so regular walkthroughs matter. Inside town limits, the Town of Bethany Beach licence also has to be renewed by June 1 each year with a signed safety certification, which makes late spring the time to test smoke detectors, check window locks and confirm GFCI outlets before the first summer guests arrive.
