Idaho law settles this in the owner's favor, the same way inside Sandpoint city limits as out in unincorporated Bonner County, where most of the homes we manage here sit. Under Idaho Code 67-6539, neither a county nor a city may prohibit short-term rentals, a short-term rental counts as a non-transient residential use for zoning purposes — the same category as a year-round house — and no county or city may require a license, fee, permit or registration to operate one. There is no vacation-rental permit to apply for, and the City of Sandpoint no longer administers one.
Lodging and occupancy taxes
Taxes still apply, and they turn on which side of the city line the home sits. Every stay of 30 days or fewer owes Idaho sales tax plus the 2% state travel and convention tax, both administered by the Idaho State Tax Commission. A home inside city limits also owes Sandpoint's 14% resort city occupancy tax, which the city collects itself. A home in unincorporated Bonner County owes the two state taxes only.
Registering and remitting
Register with the Tax Commission through Idaho Business Registration for the state taxes. City returns and payment are due monthly by the 20th, and a return is filed for every period even when no tax was collected.

Noise, nuisance, parking and traffic ordinances apply to a rental as to any other house, and a city or county may still require smoke alarms in every sleeping area, a fire extinguisher and carbon monoxide detector on each floor, escape ladders in upper-floor bedrooms, and a guest handout showing exits and an emergency contact. Private HOA covenants are separate — the statute constrains cities and counties, not a subdivision.
