Vacation Rental Taxes and Regulations in Phoenix, AZ

Short-term rentals are legal in Phoenix

Arizona law (A.R.S. 9-500.39) limits how far cities can restrict short-term rentals, and Phoenix regulates through a permit rather than a cap or a lottery. Any home rented for stays under 30 days needs its own short-term rental permit from the Planning and Development Department. The application fee is $250 and non-refundable, the permit expires one year after issue, and the department must approve or deny an application or renewal within seven days.

Lodging and occupancy taxes

Income from stays under 30 days falls under Arizona's transient lodging classification (A.R.S. 42-5070), alongside Maricopa County's share. Phoenix then adds its own privilege tax on lodging at 2.8%, plus a further 3% transient tax on stays of 29 days or less. Everything is licensed and filed through the Arizona Department of Revenue on a single TPT return — there is no separate city filing — and your TPT license number has to appear on every advertisement for the property.

Registering your rental

Order matters. Take out a TPT license at AZTaxes.gov first, because the city asks for proof of it. Register the home as a residential rental with the Maricopa County Assessor; A.R.S. 33-1902 requires that before a paying guest ever arrives. Then apply through the city's SHAPE PHX portal with liability coverage of at least $500,000 in the aggregate, a 24-hour emergency contact, a map or written description of the smoke alarms, carbon monoxide detectors and fire extinguishers, and a notarized background attestation. Before offering the home, send a certified-mail notice of intent to the neighboring properties and to any HOA or registered neighborhood association within 600 feet, then file the attestation of compliance with the mailing receipts.
