Wilmington market overview
Wilmington sits on the Cape Fear River, and visitors come for its historic downtown, the Riverwalk, and the beaches a short drive away at Wrightsville, Carolina and Kure Beach. The Wilmington and Beaches Convention & Visitors Bureau promotes the city and all three island towns together, and travellers plan their trips the same way: a Wilmington house is a base for both the river and the coast.
Demand follows the beach season but doesn't end with it. Among top-performing homes, occupancy climbs from about 53% in March to 60% in May, peaks at 70% in June and 73% in July, and stays at 50% or above through September and October. January is the low point, with about a third of nights booked, and nightly rates follow the same curve, from about $150 in January to about $240 in midsummer. Winter holds up better here than on the island beaches, so a home kept open all year keeps earning after the summer crowds leave.

It follows the shape described above, with a long season from spring through October, a July peak and a winter low, and it reflects homes run as full-time rentals rather than occasional ones. Vacation Rental Taxes and Regulations in Wilmington, NC
Can you rent your Wilmington home?
Yes, in almost every part of the city. Inside Wilmington's city limits, renting an entire home for 29 days or fewer, which the city's code calls whole-house lodging, is permitted with conditions in every single-dwelling, multiple-dwelling and historic residential district, and in the downtown, mixed-use and commercial districts. The exceptions are manufactured-home communities (MH), the residential-office district (RO) and industrial land. You don't have to live in the home. A whole-house rental needs no rental permit or registration, and the city sets no cap, lottery or spacing rule. In the downtown, mixed-use and commercial districts, a rental can't occupy the ground floor of a street-facing facade unless it is in a residential building that predates the rule. The city's Short-Term Lodging page summarises the rules, which are in Section 18-157 of the Land Development Code.
Conditions you keep meeting
- A local operator available 24 hours a day and within 25 miles of the home. Your Fairly caretaker lives nearby and can act as that operator.
- In residential and historic districts, one off-street parking space per bedroom on an all-weather surface. Shared or rented spaces in a lot or parking deck can count. In the historic districts, only curb cuts that already exist may be used for that parking.
- Commercial general liability insurance of at least $500,000 per occurrence whenever the home is rented.
- A notice posted inside the home with the operator's name and phone number, the address, the maximum number of overnight guests, the garbage collection day, the Wilmington Police non-emergency number, and a statement that parties and large gatherings are not allowed.
State law adds one more: under North Carolina's Vacation Rental Act, a vacation stay of fewer than 90 days has to be covered by a written vacation rental agreement carrying the statutory notice.
Lodging taxes
A Wilmington booking carries 13% in tax. The 6% room occupancy tax is reported monthly to New Hanover County's Finance Department and is due by the 20th day after the month being reported. North Carolina sales and use tax applies to the same receipts at 7% in New Hanover County. The tax applies to the whole guest charge, including cleaning and pet fees, not only the nightly rate.
How Fairly handles it
We register your home for New Hanover County's room occupancy tax and for North Carolina sales and use tax, and we collect and remit both on every booking. Your home is listed on Airbnb, Vrbo and Fairly.com.
Operating a vacation rental in Wilmington, NC
A Wilmington rental turns over steadily for most of the year, not in one summer rush, and it is a coastal house: summers are humid, and the Atlantic hurricane season runs from June through November, when a storm can mean securing the property and rebooking guests on short notice.
The city's lodging rules apply every night the home is rented. In residential and historic districts, one off-street parking space per bedroom has to stay available. The posted guest notice has to stay current, garbage carts go out on collection day and come back in the same day, and parties and events are not allowed. The code also requires a local operator who is available around the clock and within 25 miles of the home. Your Fairly caretaker lives nearby and can serve as that operator, and handles every turnover and walkthrough personally.
Frequently asked questions
A flat 20% commission on the rental revenue your Wilmington home earns, with no long-term contract and no hidden fees, so we're paid only when it books. That covers listings on Airbnb, Vrbo and Fairly.com, nightly pricing, guest messaging, and collecting and remitting the room occupancy and sales taxes. Your caretaker is paid from the cleaning fee guests pay and from a share of Fairly's commission.
Almost certainly, if it is inside the city limits. Whole-house rentals of 29 days or fewer are permitted with conditions in every single-dwelling, multiple-dwelling and historic district, and in the downtown, mixed-use and commercial districts. The exceptions are manufactured-home communities, the residential-office district and industrial land. You don't need to live in the home, but a local operator must be within 25 miles. Your Fairly caretaker can fill that role.
No. Wilmington once required whole-house rentals to register and capped them through a lottery. North Carolina's courts held the registration unlawful under state law, and the city removed the registration, the cap and the spacing rule from its code. The conditions that remain are parking, a local operator, liability insurance, a posted notice and no parties.
13% in total: a 6% room occupancy tax, reported monthly to New Hanover County's Finance Department, and 7% North Carolina state and local sales and use tax on the same receipts. Both apply to the whole guest charge, including cleaning and pet fees. Fairly registers your home for both taxes and collects and remits them on every booking.
