Albuquerque market overview

Albuquerque fills rentals for more reasons than most Southwest cities. Old Town, the Sandia Peak Tramway, Route 66 along Central Avenue and the bosque trails beside the Rio Grande draw leisure visitors, while Kirtland Air Force Base, Sandia National Laboratories, the University of New Mexico and the city's hospitals bring a steady stream of weekday and longer-stay guests. Santa Fe is about an hour north, so plenty of visitors base themselves here for both.

October is the year's high point. The Albuquerque International Balloon Fiesta pushes nightly rates well above any other month, and homes with room for families and pre-dawn launch mornings book far ahead. Occupancy runs highest from March through July, when spring and summer visitors overlap with work travel. January is the quietest month and November dips after Fiesta, but business travel keeps the winter calendar from emptying.

Vacation Rental Taxes and Regulations in Albuquerque, NM

Short-term rentals are allowed with a city permit

Inside Albuquerque city limits, a home can be rented for stays of 29 days or less once it holds a City of Albuquerque short-term rental permit, issued by the Planning Department. The city's zoning code does not confine rentals to particular neighbourhoods; a casita or other accessory unit qualifies where zoning allows it.

Registering your rental

Each rental unit needs its own permit, and its operator a City business registration, before the home is advertised. The application asks for the home's address, a scaled floor plan, the name and contact details of an operator or agent available 24 hours a day to respond to complaints, a signed statement that the rental will follow city codes, and proof of short-term rental insurance of at least $250,000 per unit. The permit lasts twelve months and renews each year. It ends when the home is sold, so a buyer applies afresh. The Planning Department may inspect a permitted rental without notice, and three violations within twelve months revoke the permit for two years. Your Fairly caretaker lives nearby and can act as the home's 24-hour agent.

Rules while you operate

Overnight occupancy is two adults per bedroom plus two more, counting anyone over 12: six in a two-bedroom house, eight in a three-bedroom. Gatherings may not exceed twice that number or 20 people, whichever is less, and must end by 10 p.m. The permit number appears on every listing, and the permit and the city's Good Neighbor Agreement are posted inside the home.

Lodgers' tax, hospitality fee and gross receipts tax

The City of Albuquerque levies a 5% lodgers' tax and a 1% hospitality fee on room revenue, reported to the city each month by the 25th. Rental receipts also carry New Mexico gross receipts tax, filed with the state Taxation and Revenue Department at the Albuquerque rate, currently 7.625%; the state resets local rates each July. Homes with an Albuquerque mailing address that sit outside city limits, in the unincorporated valleys, Los Ranchos de Albuquerque or Rio Rancho, follow their own county or municipal rules and taxes instead.

How Fairly handles it

Fairly registers your home for the city lodgers' tax and New Mexico gross receipts tax, then collects and remits both, with the hospitality fee, on every booking and files the city's monthly return. We assist with the permit application, the insurance documentation and each annual renewal, and your listing carries its permit number on Airbnb, Vrbo and Fairly.com.

Operating a vacation rental in Albuquerque, NM

Albuquerque sits more than a mile high in the desert, and homes here contend with strong sun, wide swings between day and night temperatures, spring winds that drive dust into every window track, and summer monsoon storms that test flat roofs and canales. Winter nights freeze, so exposed pipes and evaporative coolers need attention as the seasons turn. Fiesta week in October is the busiest turnover stretch of the year, with early-rising guests and back-to-back stays.

The city permit carries conditions an owner keeps meeting: the permit number on every listing, the permit and a Good Neighbor Agreement posted inside, overnight guests held to the bedroom-based cap, gatherings ended by 10 p.m., and an operator or agent reachable around the clock to answer complaints. Your Fairly caretaker lives nearby and can serve as that agent, handling turnovers and walkthroughs personally.
