Flagler Beach is a low-rise stretch of the Atlantic coast between St. Augustine and Daytona, with a pier, a walkable main street and none of the high-rise development that defines the beaches to its south. Guests come for exactly that, and they come across more of the year than most Florida beach towns manage.

March is the peak at about three-quarters of nights sold, but June and July hold in the mid-sixties, February reaches sixty, and April and May sit in the low fifties — a genuine spring-through-summer run rather than a single spike. Vacation Rental Taxes and Regulations in Flagler Beach, FL

First establish whether you are inside the city limits

This is the most consequential question in Flagler Beach, and it decides whether you may operate at all — not what you pay, which is the same either side.

In unincorporated Flagler County, short-term vacation rentals are permitted in all residential zoning districts, subject to the standards below. In the City of Flagler Beach, resort dwellings are not a permitted use in single-family residential, low-density residential, medium-density residential or planned unit development districts. Owners who can establish that a home was already operating as a resort dwelling before the city's ordinance took effect may continue. The city confirms eligibility by parcel.

The county rules also do not apply to buildings of three or more units, to unincorporated areas west of U.S. Highway 1, or to owner-occupied permanent residences.

Lodging and occupancy taxes

The total is 12% on stays of six months or less: Florida's state sales tax and Flagler County's surtax account for seven percent, and Flagler County adds a 5% tourist development tax. Twelve percent is what our own Flagler Beach bookings are charged, on both sides of the city line.

Cleaning, pet and traveler service fees are taxable; damage deposits and travel insurance are not. Every rental property also needs a local business tax, whatever the rental length.

Registering your rental

In the county, you need a short-term vacation rental certificate and a county business tax receipt, plus a Florida Department of Revenue registration and a Florida DBPR transient public lodging establishment licence — all four, held continuously, with an affidavit of ongoing compliance. Inside the city, you need a Resort Dwelling Local Business Tax Receipt and rental permit, on a licence year running October through September.

The county also caps occupancy at the lowest of one person per 150 square feet of conditioned space, the septic permit's assumed occupancy, or two per bedroom plus two — and no more than ten occupants in single-family districts. Off-street parking must cover one space per three guests.
